Oslo Fjord by Sail AS – Terms of Sale

1. Scope
These Terms of Sale (“Terms”) govern all bookings and purchases of sailing experiences (“Services”) offered by Oslo Fjord by Sail AS (“we”, “our”, “us”) through our website, phone, email or any authorized reseller. By placing a booking, the customer (“you”) accepts these Terms in full.
2. Booking & Confirmation
- A booking is confirmed when you complete the checkout process and receive an order confirmation by email.
- You must provide accurate contact information so that we can reach you in case of changes.
3. Payment
- All prices are listed in Norwegian Kroner (NOK). We are not currently VAT‑registered; consequently, no Value Added Tax (VAT) is charged on our services.
- Full payment is required at the time of booking unless a written agreement states otherwise.
- We accept Vipps Hurtigkasse, major credit cards and other payment methods displayed at checkout.
4. Cancellation & Rescheduling by You
4.1 Free cancellation window
You may cancel up to 24 hours before the scheduled departure time for a full refund.
4.2 Late cancellations
Cancellations received less than 24 hours before departure are non‑refundable.
4.3 Rescheduling
If you contact us more than 24 hours before departure, we will try to move your booking to another available slot free of charge. Within 24 hours we treat a reschedule request as a cancellation.
5. Cancellation by Us (Weather / Safety / Minimum Numbers)
- Sailing is weather‑dependent. We may cancel or alter an experience if conditions are unsafe, if the vessel or crew becomes unavailable, or if the minimum number of participants (stated on the product page) is not reached.
- In such cases you may choose (a) a new date, or (b) a full refund. We are not liable for additional costs you incur (transport, accommodation, etc.).
6. Participant Responsibilities
- Arrive at the meeting point at least 15 minutes before departure.
- Wear appropriate clothing and follow all safety instructions from the skipper/crew.
- Participants under 18 must be accompanied by a responsible adult.
7. Liability & Insurance
- We operate under Norwegian maritime regulations and maintain the vessel in a seaworthy condition, but each passenger participates entirely at their own risk.
- Personal insurance required: By booking you confirm that you hold adequate personal travel, accident and medical insurance that covers sailing activities in Norway.
- Liability waiver: You waive any claim against Oslo Fjord by Sail AS, its owners, employees and crew for loss, injury, damage or costs arising from your participation, except where Norwegian law prohibits such waiver (e.g. intent or gross negligence).
- Our legal liability, where it cannot be disclaimed, is limited to the direct amount you paid for the Service.
8. Health & Fitness
You are responsible for assessing whether you are physically able to participate. Inform us in advance of any medical conditions or reduced mobility.
9. Force Majeure
We are not liable for failure to perform due to events outside our reasonable control, including but not limited to extreme weather, acts of government, pandemics, or labour disputes.
10. Data Protection
Personal data is processed in accordance with our Privacy Policy and applicable Norwegian/EU law (GDPR).
11. Governing Law & Disputes
These Terms are governed by Norwegian law. Any dispute shall be settled by the ordinary courts of Norway, with Oslo District Court as agreed legal venue.
